TERMS & CONDITIONS OF USE
1. Introduction and Legal Agreement
These Terms and Conditions constitute a legally binding agreement between the User (hereinafter referred to as “you” or “the User”) and [Company’s Legal Name: K H N WORLDWIDE SYNDICATE FZCO], a registered entity in DMCC, U.A.E. authorized to practice the activity of documents clearing services, doing business under the name Notarize.ae (hereinafter referred to as “Notarize.ae”, “we”, “us”, or “our”). The Terms govern your access to and use of the Notarize.ae digital platform, including its website, scheduling systems, communication channels, payment gateways, document upload interfaces, and all other related tools and services, collectively referred to as “the Platform.”
By accessing or using the Platform, you expressly acknowledge that you have read, understood, and agreed to be bound by the Terms in full. If you do not accept any part of these Terms, you are not authorized to access or use the Platform or any of the services offered therein.
2. Scope and Nature of Services
Notarize.ae operates solely as a facilitation platform for document notarization services provided by duly licensed Notaries Public or Private Notaries operating under the laws of the United Arab Emirates. The Platform enables users to prepare, upload, and submit documents; schedule appointments; and complete necessary identity verification processes in connection with obtaining notarization.
It is hereby clarified and emphasized that Notarize.ae is not a licensed notary, nor does it purport to offer or perform notarial acts under UAE law. All notarial services facilitated through the Platform are carried out independently and exclusively by licensed notaries (“Partnered Notaries”). Notarize.ae assumes no responsibility for the notarial discretion or official decisions made by any Notary engaged through the Platform.
3. Absence of Legal Advice and Representation
Unless you have executed a formal and separate engagement agreement with a licensed legal consultancy or law firm affiliated with Notarize.ae, any communication, content, or assistance provided through the Platform must not be construed as legal advice. The information published on the Platform, including but not limited to help sections, chat responses, automated guidance tools, or customer support, is provided strictly for general informational purposes. No attorney-client relationship is formed through your interaction with the Platform.
4. Age of Eligibility and Legal Capacity
Access to and use of the Platform is strictly restricted to individuals who have attained the age of twenty-one (21) years and who possess full legal capacity to contract under the applicable laws of the United Arab Emirates and their respective jurisdictions. By registering an account or submitting any request via the Platform, you affirm that you are at least twenty-one years old and legally competent to enter into binding agreements.
During identity verification, we may require you to submit a valid and legible government-issued identification document, such as a passport or Emirates ID, which clearly displays your full name and date of birth. In the event that your identification document does not clearly show your date of birth in the Gregorian calendar format, an officially translated copy may be required.
If you are found to have misrepresented your age, your access to the Platform will be terminated immediately, and any in-process transactions or notarization requests may be permanently suspended. Any such misrepresentation may also be reported to the relevant regulatory or law enforcement authority in accordance with UAE laws governing identity fraud and cybercrime.
5. User Account Registration and Verification
To access certain services on the Platform, you are required to create a user account and complete a multi-stage identity verification process. This may include submission of a government-issued ID, passport, Emirates ID, proof of authority (where signing on behalf of a legal entity), and biometric or liveness detection measures, such as real-time video selfies or OTP-based verifications.
By registering, you confirm that all information provided is complete, accurate, and up to date. Failure to provide required documents or to pass our KYC (Know Your Customer) or AML (Anti-Money Laundering) screening may result in immediate suspension or denial of services. Any suspicious, misleading, or forged submission will be reported to appropriate authorities without prior notice.
6. Use of Platform and User Conduct
You agree to use the Platform solely for lawful purposes and in compliance with these Terms. You are prohibited from uploading any content that is fraudulent, infringing, defamatory, obscene, or otherwise unlawful. You shall not interfere with or circumvent any security or access-control features of the Platform, and you shall not attempt to reverse-engineer, replicate, or exploit any aspect of the Platform’s code, user interface, or processes.
7. Notarization and Document Standards
You are solely responsible for ensuring that all submitted documents are accurate, legally valid, and clearly readable. If the document requires a certified Arabic translation or notarized translation, it is your responsibility to obtain and submit it in a timely manner. Failure to meet formatting, content, or authentication requirements may result in delay or refusal of the notarization.
Acceptance of a document by Notarize.ae does not imply that it is eligible for notarization. Final discretion lies solely with the Partnered Notary as per UAE law.
8. Appointments and Scheduling
Notarize.ae allows Users to propose preferred time slots for notarization. Confirmation of an appointment is subject to the availability of Partnered Notaries, the complexity of the request, and completion of prerequisite requirements. Notarize.ae does not guarantee a specific timeline unless such guarantee is explicitly issued in writing.
9. Fees, Invoicing, and Payment Terms
All applicable service charges, including Notarize.ae facilitation fees, Notary fees, translation costs, administrative surcharges, and VAT, are payable in advance unless otherwise agreed. All payments shall be processed via secure payment gateways integrated into the Platform/Payment link provided by us. The User agrees that any applicable official fee increases by UAE authorities may be reflected without notice.
10. Cancellations, Refunds, and Rescheduling
Cancellations and rescheduling requests must be submitted no less than twenty-four (24) hours before the confirmed appointment time. Refunds, where permitted, will be subject to deduction of any non-recoverable third-party costs already incurred. Notarize.ae is not liable for delays, rejection, or non-performance arising from the User’s failure to submit correct or complete documentation.
11. Limitation of Liability
To the fullest extent permitted by law, Notarize.ae shall not be liable for any indirect, incidental, punitive, or consequential damages, including but not limited to loss of data, loss of profits, loss of opportunity, reputational harm, or legal penalties arising out of or in connection with your use of the Platform. Our maximum liability in any matter shall not exceed the total amount paid by the User for the specific transaction giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Notarize.ae, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses, including legal fees, arising from your breach of these Terms or violation of applicable laws or third-party rights.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. The Dubai Courts shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, unless an arbitration clause is mutually agreed and documented separately in writing.
14. Amendments
We reserve the right to amend these Terms from time to time. Updated versions will be published on the Platform, and, where materially significant, Users will be notified via email or Platform announcement at least fourteen (14) days prior to the changes becoming effective.
